Reyna R. ROMERO, v. UNITED STATES DEPARTMENT OF THE INTERIOR
"Ponderosa National Park is one of the most visited National Parks in the United States and is known for its massive granite cliffs, the most popular being the world-famous Otter Rock. Dr. Reyna Romero began her employment as a Wildlife Biologist at Ponderosa in 2022. On May 5, 2024, one of her days off, Dr. Romero and four non-NPS friends climbed Otter Rock and displayed an over 2,000-square-foot flag reading "Immigrants Make America Great!" for approximately four hours. She wore a NPS employee t-shirt while taking part in the demonstration and briefly provided directions to tourists before ascending the cliff. The Park terminated her for participating in an unauthorized demonstration in violation of 36 C.F.R. § 2.51, which requires permits for demonstrations in national parks. The termination letter also referenced "documented concerns" about her performance as a probationary employee. The two issues before the United States Supreme Court are (1) whether a federal employee's off-duty political speech is protected under the First Amendment when the speech occurs at their place of employment; and (2) whether a federal agency violates the First Amendment by selectively enforcing workplace regulations against an employee based on the viewpoint they expressed in off-duty political speech when the agency tolerated similar conduct by other employees expressing different political viewpoints."
