Case Before the Court:
In Boumediene v. Bush, a case now pending before the United States Supreme Court, aliens that are detained as enemy combatants at the Guantanamo Bay Naval Base in Cuba petition for writ of habeas corpus. The Boumediene Petitioners are five Algerian-Bosnian citizens and one Algerian citizen with permanent Bosnian residency. At the request of the U.S., all were arrested in Bosnia-Herzegovina by Bosnian police in October 2001 and brought to Guantanamo by U.S. forces in January 2002. For tournament purposes, our "Supreme Court" will be reviewing both the issue of whether these detainees have a right to habeas and if so, whether Congress has given the detainees a sufficient alternative to habeas through the Combatant Status Review Tribunals (CSRTs) provided for under the Military Commissions Act of 2007.
