Case Before the Court:
Chaker v. Crogan: Respondent, Darren Chaker, was
convicted by a jury for filing a knowingly false complaint
of peace officer misconduct in violation of California Penal
Code § 148.6. Respondent alleges that California Penal
Code § 148.6 violates the First Amendment because the
statute targets only knowingly “false” speech critical of
peace officer conduct during the course of a complaint
investigation. Petitioner, Alan Crogan, the San Diego
Police Department and State of California, argue that the
case is moot and that California Penal Code § 148.6 does
not violate the First Amendment. The United States Court
of Appeals for the Ninth Circuit held California Penal
Code § 148.6 in violation of the First Amendment and
ruled that the case was not moot. The United States
Supreme Court granted certiorari on these two issues.
