Each year the University of San Diego publishes an Annual Campus Safety and Security Report, as required by the federal Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act (the “Clery Act”).  Under federal law, we are required to compile and publish statistics regarding the occurrence of certain criminal offenses that are reported either to the local police agency or to any official of the institution who is considered to be a Campus Security Authority under the Clery Act. 

Examples of Campus Security Authorities at the University of San Diego include all full-time members of the Department of Public Safety, the Dean of Students and certain other Student Affairs administrators (excluding pastoral and professional counselors as defined below), members of the Athletics Administration, coaches, advisors to student organizations, and certain members of the Residential Life staff including the Director, Associate Director, Assistant Directors, Resident Faculty, Resident Directors, Resident Assistants, and Resident Fellows. 

Pastoral counselors and professional counselors are not Campus Security Authorities under the Clery Act.  A pastoral counselor is defined as a person who is associated with a religious order or denomination, who is recognized by that religious order or denomination as someone who provides confidential counseling, and who is functioning within the scope of that recognition of a pastoral counselor.  A professional counselor is defined as a person whose professional responsibilities include providing mental health counseling to members of the university’s community and who is functioning within the scope of his or her license or certification.   

As a Campus Safety Authority, you are required to report Clery Act qualifying criminal incidents to the Department of Public Safety, including the following:

Murder and non-negligent manslaughter
Negligent manslaughter
Forcible sex offenses
Non-forcible sex offenses
Robbery
Aggravated assault
Burglary
Motor vehicle theft
Arson
All hate crimes involving bodily injury or property damage
All liquor, drug or weapons law violations resulting in an arrest

If you observe any of these crimes, or if any person reveals to you that he/she learned of or was the victim of, perpetrator of, or witness to any of these crimes, you are expected to immediately contact the Department of Public Safety to have a crime report taken by a public safety officer.  Please do not investigate the crime or attempt to determine whether a crime, in fact, took place. Simply make the report. Appropriate personnel may later contact you or others to gather additional information.

We also ask that you immediately report any crime that is observed by or reported to you so that the Department of Public Safety can document the incident and take action as appropriate under the circumstances.  If there is any doubt as to whether a crime is reportable, you should err on the side of reporting the matter.
To ensure that you are aware of your responsibilities, the University of San Diego provides training on Clery Act compliance for our Campus Security Authorities.    To access and complete this training, please select from the links at the bottom of this page.
