VICAM Receives Awards at 24th Vis Moot in Vienna, Austria

Vienna (April 7-13, 2017) –338 teams from over 75 countries, including the University of San Diego (USD) School of Law VICAM team, competed in the 24th Vis Moot in Vienna, Austria.  Representing USD VICAM in Vienna were 3Ls Erin Lupfer, John Nelson, Melissa Chinn, and 2L Domenic Martini.

The object of the Vis Arbitral Moot is to have students get involved in international commercial arbitration and encourage the resolution of business disputes by arbitration.  The fictional problem for the Vis Moot is always based on an international sales transaction that is subject to the United Nations Convention on Contracts for the International Sale of Goods (CISG) and also involves procedural issues of arbitration, with the procedural rules rotating each year.  

This year's Vis Moot problem involved a contractual dispute regarding the exchange rate and a bank charges clause between fan blades producer Wright, Ltd. ("Claimant") and jet engine producer SantosD KG ("Respondent").  The contract between Claimant and Respondent included an arbitration clause stating that any disputes between the parties would be conducted in line with the Center for Arbitration and Mediation, Chamber of Commerce Brazil-Canada (CAM-CCBC) rules.  The problem was released in October 2016.  Lupfer and Nelson submitted a memorandum on behalf of Claimant in December 2016, and Martini and Chinn submitted a memorandum on behalf of Respondent in January 2017.  
Among the more than 2,000 students competing, Lupfer and John each received Honorable Mention Individual Oralist awards.  To be eligible for an individual oralist award, a competitor must argue on behalf of both Claimant and Respondent.  The top 64 of eligible competitors receive Honorable Mention awards.  
USD VICAM is a student-run organization that competes in the area of international commercial arbitration.  Each year, USD VICAM sends students to compete in the Vis Moot in Vienna, Austria, the Vis East in Hong Kong, and a domestic competition.
