In a recent edition of Pharma Technology Focus, the question is raised of whether a legal dispute between two data and technology companies in the pharmaceutical industry in an antitrust issue. Richard Custin, a clinical professor of business law and ethics at the University of San Diego School of Business is cited in the article emphasizing the importance of antitrust laws in this industry.

He comments that “Data sharing is at the legal intersection of patent, privacy and antitrust law. While the FTC and Department of Justice recognize that information exchanges are inevitable and do not necessarily harm competition, companies need to be cautious that the exchanges do not ‘harm competition and consumers in violation of antitrust laws'.”
