Updates to Federal Policy and Protocols: What You Should Know
University resources available following recent Federal action
The University of San Diego (USD) reaffirms its commitment to fostering a welcoming and supportive environment for all students, faculty and staff. With changes to policy and proposed legislation at the Federal level, USD is providing the information, guidance and resources outlined below to help our community navigate these ongoing changes. Information and resources developed previously are available on the USD website, and members of the community are working to review and update these pages as needed.
Existing Protocols for External Law Enforcement Requests
The University of San Diego prioritizes the safety and privacy of its students and employees. In the past, outside law enforcement agencies have come to campus for investigations under their jurisdiction. For any outside agency that comes to campus, it has always been USD’s protocol to direct officials to the Department of Public Safety (DPS) first to verify there is a legitimate, lawful request and then to respond as required under the law.
USD has established protocols to manage interactions with external law enforcement agencies:
- USD will not disclose student or employee information, including immigration status, except in response to a judicial warrant, subpoena, or other legal mandate or under exigent circumstances.
- DPS will not assist ICE or other law enforcement agencies in immigration enforcement activities on campus unless required by a valid legal mandate or in emergency situations.
- Directing Inquiries: If you hear about, witness or are approached by officials from outside law enforcement agencies seeking access to university facilities, students or records, direct them to the USD DPS.

Student Records and Privacy
Federal privacy laws (absent a health or safety emergency) generally prohibit the release of information from a student’s records to law enforcement officers except pursuant to a valid court order or subpoena, both of which must be lawfully issued, as determined by the Office of General Counsel, or upon the written consent of the student. USD adheres strictly to the Family Educational Rights and Privacy Act (FERPA), ensuring the confidentiality of student records.
- Non-Disclosure: The university does not release information about students to third parties without consent, unless required by law or court order.
- FERPA Compliance: Faculty and staff are reminded of their obligations under FERPA to protect student information, including contact details, grades, medical records, and other personal data.
