This ethics seminar will focus on the ethical issues relating to the various areas of law. Through scenario examples, the course will examine confidentiality, privilege and conflict issues as they relate to paralegals and attorneys. The course will also cover independent duties and liabilities of paralegals/attorneys as they relate to following questionable directives.

Good legal drafting and writing is a critical skill for attorneys and paralegals. This course will examine the fundamental objectives of legal drafting and writing from a transactional perspective and will include discussion about the importance of clarity, conciseness and comprehension. There will also be a discussion of commonly used phrases and provisions, including a discussion of so-called "boilerplate provisions."
BANKRUPTCY MYTHS (2 MCLE Credits)

This class will review the provisions that protect debtors experiencing foreclosure, and then discuss the current qualifications for consumer bankruptcy. The course will examine two statutes from The California Code of Civil Procedure related to the foreclosure of real property that save many Californians from post-foreclosure liability. Furthermore, a section of the Internal Revenue Code designed to mitigate tax consequences from foreclosed real property will be examined.

Sensitive evidence commonly includes medical records, bank records, and psychological or psychiatric records. Improper dissemination of these facts may give rise to civil claims such as invasion of privacy, defamation, and intentional infliction of emotional distress. This program will discuss the law of defamation and invasion of privacy, how claims arise in the course of working on a case, and how to avoid the situations that most commonly give rise to such allegations.
