San Diego (February 22, 2017) - University of San Diego (USD) School of Law current 3L student Nathan N. Kiyam presented at the 2016 Artist Endowed Foundation Forum in New York City at the Morgan Library and Museum. 

Kiyam’s presentation was based on an article he wrote that disclaimed the assets of artists’ estates. He specifically focused on estate planning for artists and the unique conflicts that occur within artist’s families when disclaiming their assets to a foundation that the family is affiliated with.

Kiyam writes, “Disclaimers are employed by estate planning counsel [to] provide posthumous flexibility to accommodate risks and unexpected issues that may arise over time [and] disclaiming for charitable purposes … generate[s] an estate tax charitable deduction.” He also discusses how conflicts arise when an artist creates an estate plan involving family members affiliated with a foundation the artists creates. These conflicts could arise, from the IRS's perspective, when the family members disclaim their inheritance to go to the foundation while sitting on the board of the foundation, thereby maintaining a certain amount of control over the assets.  

The event, hosted by the Aspen Institute and University of Miami School of Law, joins foundations from around the world including the Pollock-Krasner Foundation, Roy Lichtenstein Foundation and Andy Warhol Foundation. This invitational symposium is meant to discuss the issues and innovations in practice and policy for senior artist-endowed foundation leaders. Kiyam’s article is forthcoming the National Study of Artist-Endowed Foundations.
