A Panel Discussion on Qualified Amended Returns
Treasury Regulation § 1.6664-2 permits a taxpayer to avoid an accuracy-related penalty by filing a Qualified Amended Return (QAR) to self-correct an error on an original return. Mr. Hurwitz and Mr. Milikowsky will provide an overview of QARs and how they are utilized in practice.
Stuart Hurwitz is an attorney at CPA and Law Offices in San Diego specializing in tax, audit, estate planning, business planning, and procedural and business issues at the state and federal levels. He is a Certified Specialist in Taxation. The Super Lawyers, Corporate Counsel Edition named Mr. Hurwitz a “Super Tax Lawyer” in 2009, 2010, and 2012. He was also named a “Five Star Wealth Manager” in 2010, 2011, and 2012 in San Diego Magazine. Apart from his numerous accolades, Mr. Hurwitz has authored and co-authored a number of research papers, including Qualified Amended Returns: Expanding the Safe Harbor, Valuation and Court-Appointed Experts: Hats Off to the U.S. Tax Court for Using Federal Rule of Evidence § 706 and To What Extent Can an Attorney Participate in the Writing of an Expert’s Witness Report in Tax Court, among other articles.
John Milikowsky is a shareholder at The Law Offices of John D. Milikowsky. Mr. Milikowsky’s practice focuses on tax controversy and compliance, business formations, business transactions, corporate governance and real estate transactions. Mr. Milikowsky co-authored a research paper with Mr. Hurwitz entitled Qualified Amended Returns: Expanding the Safe Harbor. In 2009, Mr. Milikowsky presented a tax proposal on Qualified Amended Returns to the U.S. Treasury, Internal Revenue Service and Congressional subcommittee staff members.
