AbstractThis Comment analyzes the scope of contractual assent on the Internet as applied to the enforceability of browse-wrap licenses, and argues that courts should uphold such licenses. The author begins by presenting the background of mass market licensing agreements and outlines the current law regarding previous types of wrap agreements. He then discusses the UCITA view on mass-market licenses and explores the policy issues surrounding mass-market agreements. The author then analyzes the benefits of browse-wrap licenses and recommends that courts consider these benefits before ruling against them.
