| Abstract | The common law imposed on husbands the obligation to offer support during marriage to their wives. This obligation was reciprocated by the wife’s obligation to perform domestic labor during marriage, namely domestic labor. In 1872 California adopted a statute providing that “husband and wife contract toward each other obligations of mutual respect, fidelity, and support.” The terms of this statute remain unchanged today in California Family Code § 720. This article discusses the obligations of spouses as indicated by common law, statutes, and separation agreements. |
