| Abstract | Who gets to determine whether a Member is abiding by the most-favoured-nation principle in its trademark law? Who gets to determine whether a Member's trademark law or implementation contrary to this principle is immunized by one or another of the TRIPs exceptions to the principle's operation? These tasks fall to the dispute-resolution facilities of the WTO that were established in the TRIPs Agreement.
