| Abstract | This Article examines Article 1712 of NAFTA which requires member countries to "refuse to register, or invalidate the registration of, a trademark containing or consisting of a geographical indication with respect to goods that do not originate in the indicated territory, region or locality, if use of the indication in the trademark for such goods is of such a nature as to mislead the public as to the geographical origin of the good, and its effects on primarily geographically deceptively misdescriptive marks. |
