| Abstract | A survey of McDonald's trademark infringement litigation suggests that the company is extremely aggressive in claiming trademark rights against apparent non-competitors as well as obvious competitors. Most notably, McDonald's has aggressively pursued businesses using the prefix "Mc" along with a generic word to describe a non-McDonald's product or service. In other cases, the company's assertion of trademark infringement has been ancillary to claims sounding more clearly in unfair competition. |
