| Abstract | Whatever else they accomplish for their owners, trademarks function to identify source. The main reasons we are willing to protect trademarks relate to consumers' ability to use them in searching for the goods and services they want. These general principles admit a little room for compromise. In this memo I compare and contrast three such compromises, each of which is contemplated by the federal trademark law: concurrent use, assignment, and licensing. |
