| Abstract | A survey of cases shows that federal preemption will be a significant issue for state mark registrants who attempt to rely on favorable state law to compete against federal registrants. A key focus in planing a state-based business or litigation strategy will be on whether, and the extent to which, the state law compromises the federal trademark scheme. |
