AbstractIn California, awards of alimony pendente lite, also called temporary alimony (maintenance, spousal support), require one spouse to provide financial support to the other during the pendency of most proceedings covered by the Family Code. The doctrine on alimony pendente lite has remained quite stable under California statutes dating to 1872. After jurisdictional, procedural, and substantive criteria are satisfied, the trial court has considerable discretion in setting the amount of the award. This article dissects the use of pendente lite.
