Title?Support? in the Duty of Spousal Support During Marriage

AbstractThe statutory obligation of California spouses to support each other during their marriage dates at least as far back as 1872. Courts have said this obligation of support is an implicit term of the marriage relationship, just as binding on the spouses as if an express avowal of the obligation had been made. The term ?support? in this obligation, however, is not clearly defined. The case law indicates that the entitlements of ?support? during marriage are rather different from the purely financial concept of ?spousal support? we associate with divorce. This article discusses the statutory obligation of California spouses to support each other during their marriage through the study of relevant case law and statutes.
