AbstractToday, due diligence requires searches in international, multinational, and other countries' mark databases. The U.S. markholder is well advised to make the search of the readily available database maintained by the World Intellectual Property Organization (WIPO) part of the routine, if only to see whether any similar marks are on file in other countries that might present future conflicts. As particular overseas markets become targets for goods bearing the mark, the search must broaden to include databases providing information on marks claimed in those local or regional markets. And when the need arises for a deeper search than the easily accessible mark databases, the markholder should consider contacting a professional mark search firm.
