The provision in the Obama Administration's 2010 health care law requiring Americans to buy health insurance or face tax penalties has been challenged as unconstitutional under the Commerce Clause of the United States Constitution. Two federal appellate courts have ruled on the issue, with each court taking a different view. The Sixth Circuit Court of Appeals has ruled the "individual mandate" constitutional. The Eleventh Circuit Court of Appeals has ruled that individual mandate violates the Clause. A decision from the Fourth Circuit Court of Appeals is expected shortly. The United States Supreme Court may hear the case as early as this fall.
