Air Quality

AB 2388 (Vargas) Mitigation Fee for Border Power Plants

Would impose a $0.001 per kilowatt-hour air contaminant emission electricity generation mitigation fee on electricity imported from certain power plant in the border region along California and Mexico. The bill also would establish the Imported Electricity Air Pollution Mitigation Subaccount in the Air Pollution Control Fund for the proceeds of the fee.

AB 2553 ( Arambula) CA Air Quality Zone Credits

Would authorize the Business, Housing, and Transportation Agency to designate CA Air Quality Zones. Would also require the California Infrastructure and Economic Development Bank to establish a program to provide low- and zero-interest loans to finance qualified capital expenditures based on specified criteria.

SB 1205 (Escutia) Penalties for Stationary Pollution Sources

Would increase civil penalties for stationary source pollution violators.

SB 1252 (Florez) Penalties for Particulate Matter

Violations Would permit the state board or any district to impose, in addition to any other civil and criminal penalties, a civil penalty of up to $25,000 per violation for any discharge of specified particulate matter in violation of state and federal standards. After January 1, 2010,the penalty would increase up to $50,000.

California Energy Commission

 

SB 204 (Bowen) Energy Commission Membership

Would prohibit anyone from being a member of the Energy Commission who within the last 2 years received a substantial portion of their income from a person or corporation subject to regulatin by the Commission.

Climate Change

AB 32 (Pavley) California Global Warming Solutions Act

Would enact the CA Global Warming Solutions Act of 2006, designating the state board as the agency in charge of monitoring and reporting on greenhouse gas emissions. The state board would also set emissions limits and monitor compliance with these limits. The Act would also change the existing responsibilities of the Energy Commission such that they would update their current inventory of emissions to supplement the state board.


AB 1925 (Blakeslee) Carbon Dioxide Recycling

Would require the Energy Commission to recommend to the Legislature how they can facilitate cost-effective strategies to recycle carbon dioxide that is created during the generation of electricity.


SB 1368 ( Perata) Greenhouse-gas Emissions

Would require long-term contracts for baseload generation to comply with CEC's performance standards for greenhouse-gas emissions and establishes an emissions standard that is equal to that of a combined cycle natural gas power plant.

Distributed Generation

AB 2778 (Lieber) Self-generation Incentive Program

Would require the PUC to administer until 1/1/12 the Self-Generation Incentive Program for distributed generation resources applicable to all eligible technologies (other than photovoltaic). Would also require the PUC to submit an evaluate of the program to the Legislature by 7/1/10.


SB 1048 (Machado) Distributed Generation

Declares support for distributed generation fueled by gas produced in association with oil production.

Energy Efficiency

AB 993 (Canciamilla) Energy Efficiency Training

Would require the board of governors of the CA Community Colleges to establish a Facilities Energy Management Resources and Training Consortium consisting of programs offered at 6 campuses; resource centers would train technicians and offer certificates and degrees in partnership with industry, utilities, and
energy services partners.


AB 1970 (Levine) Appliance Labels

Would require manufacturers of appliances sold in California to provide energy use labels that would show estimated annual operational cost both when the appliance is in the "active/on" mode and when it is in the "active/standby" mode. AB 2021 Levine Energy Efficiency Goals for Municipal Utilities Would require the CEC to, every 3 years starting 6/1/07, (i) identify all potentially achievable cost-effective electricity and natural gas efficiency savings, (ii) establish statewide annual targets for energy efficiency savings and demand reduction over 10 years, (iii) develop a plan to improve the energy-efficiency of air conditioners in the state, and (iv) for each local publicly owned electric utility, prepare a report comparing the utility's annual targets and its actual energy efficiency savings and demand reduction. Would also require every local publicly owned utility to contract for independent evaluation of energy efficiency savings and report this to the CEC and customers.


AB 2321 Canciamilla Governor's Green Action Team

Would create the Governor's Green Action team of at least 18 members to implement the goals identified in Executive Order S-20-04 (Green Building Order). The Team would oversee and direct progress towards reducing electricity purchases for state-owned buildings and other government entities by 20% by 2015.

AB 2021 (Levine) Energy Efficiency

SB 1250 (Perata) Cost-effective Efficiency Programs (refrigerators)

Would delete the continuous appropriation of funds to the CEC for the renewable energy resource program. Would revise the purpose of funds as allocated by the Reliable Electric Services Investments Act. Would also delete the authorization that the CEC may administer a program that is designated by the PUC to receive funds from the Natural Gas Consumption surcharge fund for public interest R&D.

Generation

AB 1317 (Torlakson) Tax revenue from Utility Property

Would require that the assessed value of qualified property, as defined, placed in service by a public utility on or after January 1, 2007, be allocated entirely within the county in which the property is located, including to the county, certain special districts, and school entities. Would make this change for the 2007-08 fiscal year and for each fiscal year thereafter.

Liquefied Natural Gas (LNG)

SB 426 (Simitian) LNG Impacts
 

Would enact the Liquified Natural Gas Terminal Evaluation Act to require the CEC to assess the impacts of every LNG terminal pursuant to the Act.

Oil

SB 1794 (Dunn/Kehoe) Regulation of Oil Refineries

Would declare oil refineries to be public utilities subject to regulation by the CPUC under the Public Utilities Act, but limits this by not authorizing the CPUC to to establish rates for refinery products.

Planning

AB 974 (Núñez) Grid reliability reports

Would require utilities to file by July 1, 2008 and every year thereafter a report to the California Public Utilities Commission identifying needed system improvements. Would also require the California Independent System Operator to file a report identifying necessary upgrades and expansions.

AB 1632 (Blakeslee) CEC Assessment of Power Plant Vulnerability

Would require CEC as part of its annual energy assessment to compile and assess studies to determine the vulnerability of baseload power plants to a major seismic event or disruption due to aging. The CEC would also have to assess the potential state and local costs of accumulating spent fuel onsite at the state’s nuclear power plants.

AB 2960 (Ridley-Thomas) Price-risk Assessments in Procurement Plans

Would require utilities’ proposed power-procurement plans to include an price-risk assessments, including an evaluation of the dependency of each resource on natural gas."

SB 1539 (Kehoe) Regional Energy Planning in San Diego Region

States legislative intent that the PUC and the Energy Commission reimburse San Diego Association of Gov. Energy Working Group for costs incurred by participating in certain proceedings and energy related activities.


SB 1669 (Kehoe) Procurement Information Disclosure

Would require all load serving entities to publicly disclose information related to any procurement activities regulated by the commission, including resource adequacy and renewables portfolio standard requirements. The bill would allow Division of Ratepayer Advocates and other non-market participants that represent consumers to have access to information relating to procurement that is not publicly available.

Public Utilities Commission

AB 2391 (Levine et al.) CPUC Reporting

Would require the PUC to report to the legislature by 7/15/09 on the energy efficiency and conservation programs they oversee. Would also require the PUC's plan, report, and accounting to be submitted annually to the Governor and Legislature no later than February 1st.


SB 951 (Escutia) Intervenor Compensation

Would provide that provisions pertaining to participant and intervenor compensation are to be liberally construed to encourage participation.


SB 1753 (Dunn) Repeal of the PUHCA of 1935

Would require the PUC to report to the Legislature on how repeal of the Public Utilities Holding Company Act of 1935 could adversely impact CA consumers.

Rates/Tariffs

AB 1969 (Chavez/Yee) Renewable Energy Tariffs

Would require every electrical corporation to file with the PUC a standard tariff for renewable energy output produced at an electric generation facility that is an eligible renewable energy resource.


AB 2104 (Lieber) Accessibility of CARE applications
 

Would require the development of a process whereby electrical and gas corporations are able to directly accept and renew CARE applications from certain tenants of a mobile home park or apartment building.


AB 2576 (De La Torre) Alternate Energy Rates Eligibility Guidelines

Would require the PUC to ensure that an electrical or gas corporation with a program approved to provide economic need-based discounts use a single application form.


SB 1554 (Bowen) Cost Recovery Surcharge

Would prohibit the CPUC from imposing any charge, including a cost responsibility surcharge, on a customer of a local publicly owned electric utility if the customer's service location has not previously received service from an electrical corporation.

Renewable Energy

AB 2189 (Blakeslee) Small Hydro Eligibility for Renewable Portfolio Standard

Would provide that a small hydroelectric generation facility that is an eligible renewable energy resource retain eligibility so long as efficiency improvements to the facility after 1/1/03 cause the generating capacity to exceed 30 megawatts and does not require new or increased appropriation of water.


AB 2756 (Levine) Clean Renewable Energy Bonds

Would require the Department of General Services and
Cal State University to identify and submit to the State Public Works Board projects that will comply with the requirements of the federal law establishing the authorization for clean renewable energy bonds.

SB 1294 (Ducheny) - Geothermal Waste Exemption

This bill would exempt from the hazardous waste control laws geothermal waste generated from the exploration, development, or production of geothermal energy that does not result from drilling for geothermal resources, if the geothermal waste meets specified management requirements and conditions, including that the waste is a hazardous waste that is exempt from the federal Resource Conservation and Recovery Act of 1976 (RCRA). Since a violation of the bill's requirements would be a crime, the bill would impose a state-mandated local program.

Renewable Energy - Solar

AB 1383 (Pavley) Low-Income Housing Revolving Loan for Solar

Would establish a revolving loan fund for solar energy systems on low-income housing and would require the CEC to determine adequate funding to achieve the goal of placing such systems.


AB 2573 (Leno) Solar Generation Limit (Hetch Hetchy)

Would limit the peak generation capacity of the Hetch Hetchy Water and Power photovoltaic electricity generation facility to 25 megawatts and would make other changes to the rules governing photovoltaics in that utility territory.


AB 2723 (Pavley) Low-Income Revolving Loan Program

Would create the Low-Income Housing Development and Nonprofit Building loan program to help finance solar energy systems in eligible low-income housing and nonprofit building. The program would be funded by an allocation of 10% of the CA Solar Initiative funding.


AB 2806 (Hancock) Tax Exemption: Solar Energy Systems

Would provide that solar panels and photovoltaic cells included as part of a solar energy system shall be considered materials when furnished and installed in the performance of a construction contract.


SB 1 (Murray) Solar Energy Net Metering

Would require developers of new homes to offer solar energy system options as of 1/1/11 and require the CEC to develop an offset program that would allow developers to forgo this requirement if they automatically install solar energy systems, as defined, on other projects. Would mostly prohibit the CEC from requiring that solar energy systems be installed on a residential building. Would also require the PUC to establish monetary and performance-based incentive programs, and expand the availability of net-energy metering.

SB 1059 (Escutia) Transmission Corridors

Directs the CEC to develop a transmission corridor zone and review and revise it at least once every 10 years.

Transportation

AB 2264 (Pavley) Fuel Economy Standards

Would require the Department of General Services, in conjunction with the Energy Commission, to establish a minimum fuel economy standard for state fleet vehicles by 6/1/07, and that they meet this standard by 1/1/08.


AB 2647 (Oropeza) Truck Retrofit assistance program

Would establish the Truck Retrofit Assistance Program to help finance the purchase and installation of truck cab and parking space electrification technologies and SmartWay Upgrade Kits.


SB 757 (Kehoe) Transportation efficiency and alternative fuels use.

Would enact the Oil Conservation, Efficiency, and Alternative Fuels Act, which would declare it is state policy to take cost-effective measures to increase transportation energy conservation, efficiency, and use of alternative fuels. Would require CAL EPA to assess progress and report to the Legislature.


SB 1505 (Lowenthal) Hydrogen-based Alternative Fuels

Would state legislative intent that, when the "CA Hydrogen Highway Network Blueprint" is implemented, it be done so in a clean and environmentally responsible manner.


SB 1675 (Kehoe) Diesel Fuel

Would require all diesel fuel sold for use in internal combustion engines to contain at least 2% renewable diesel fuel by 2008 and 5% by 2010.


SB 2744 (Wyland) Office of Special Counsel on Transportation Fuels

Would create an Office of Special Counsel on Transportation Fuels which would promote energy conservation and competition in transportation fuel supply
